General terms and conditions of sale

Article 1

Our sale prices are indicative. They may be automatically revised by us in the following cases:

- Increase in raw material prices
- Pay rises
- Parity exchange of the currency in which our commodities are quoted
- Increase in energy prices
- Substitution of missing raw materials with others: changes in procurement sources due to reasons independent of our will

This enumeration is not exhaustive. Some sales prices may be quoted in foreign currencies: the exchange rate is that, valid on the date of the offer, and any change in this rate will automatically trigger the revision of the listed prices

Article 2

All our deliveries are paid in cash, if no other written agreement exists.

Article 3

All commitments made by our representatives become valid only after written confirmation by us.

Article 4

The uniformity of the colour of our printing inks used, as well as of our paper, cannot be guaranteed.

Article 5

Our delivery times are indicative only. Under no circumstances can we be held responsible for any damage or loss incurred due to late delivery. Machinery breakdown, lack of power or energy, strike, fire, flood, etc. are considered cases of force majeure. This enumeration is not restrictive.

Article 6

The goods are sold ex-factory. Transport is the responsibility of the buyer, even if the goods were sold carriage paid.

Article 7

All goods that cannot be delivered within the specified time due to a cause dependent on the buyer will be stored at his risk. The storage charge will be 2% per month from the first day of storage. Each month started will be charged in full. Furthermore, we reserve the right to place these goods in a storage facility at the buyer's expense, and this after a notification by registered letter, which has not been acted upon within 8 working days following its dispatch date.

Article 8

The following tolerances, in plus or minus, on the ordered quantities are permitted:

Less than 4990 units: 25%
from 4990 to 9999: 10%
from 10000 and more: 5 %

These quantities apply per format, per print, per quality, per model, per processing and per delivery.

Article 9

The following tolerances, in plus or minus, on the ordered formats are allowed:

Thickness: ± 10%
The length: ± 3%
Width: ± 7%

Article 10

Due to automation of our manufacturing processes, it is technically impossible to avoid producing a few bad specimens. A tolerance of maximum 1% per shipment is allowed for this.

Article 11

All our works are performed at the risk of the customer, who is solely responsible to us and to third parties, in case of prosecutions for counterfeiting patented packaging.

Article 12

1. Plans, drawings,models, proofs, etc., which are not the subject of an order will be charged or returned according to our instructions.

2. Printing stamps manufactured by us remain our property, even if the customer has paid part of the cost.

3. The participation in expenses assures the customer that this material will be used exclusively for him, and that the moment it is taken out of circulation for some reason

4. Storage of this material can only be guaranteed up to one hair after its last use

5. The plans, drawings, proofs, films, models, etc. belonging to our customers stay in our premises at their own risk

Article 13

Any complaint concerning a shipment must be made within eight days of the date indicated on the waybill or shipping note. In case of poor delivery, our responsibility is limited to the replacement, within our normal delivery times, of the part of the shipment that is the subject of the complaint. Whatever the consequences of the faulty delivery, it will never give the right to a claim for compensation.

Article 14

Our invoices are payable in Olen. In case of non-payment of an invoice on its due date, all sums still due will automatically and without notice become payable. An interest of 3% above the base rate of the national bank per month will be applied for all invoices not paid on their due date. In addition, damages of 10%, with a minimum of €125 will be claimed automatically and without notice on the amount of the invoice.

Article 15

The seller retains title to all goods delivered as long as the buyer has not fulfilled all his obligations towards him. This means that, in the meantime, the buyer does not have the right to sell these goods or give them as guarantee to third parties. Consequently, delivered goods remain the property of the seller until they have been paid for in full.

Article 16

Any disputes that may arise will fall under the jurisdiction of the Turnhout District Court.

Article 17

We do not take into account the terms and conditions of purchase printed on our customers' letters or other documents. When ordering, the buyer acknowledges having read and agreed to our terms and conditions of sale, mentioned on this page.
